By downloading, installing, or using the Smak mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms apply to all users of the App.
Smak is a mobile application that helps groups of people decide where to eat by allowing users to create shared sessions, browse nearby restaurants, swipe on options independently, and discover mutual matches. Restaurant data is provided via the Google Places API.
You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you confirm that you have your parent or guardian's permission to use the App.
Smak does not require account registration. Sessions are identified by temporary 6-digit codes. You are responsible for keeping your session code confidential and for all activity that occurs within sessions you create or join. Session data is automatically archived after a period of inactivity.

The App, including its name, logo, design, and all content, is owned by Smak and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. You may not copy, modify, distribute, or create derivative works based on the App without our express written consent.
The App uses Google Places API to provide restaurant data and Firebase to store session information. Your use of the App is also subject to Google's Terms of Service (https://policies.google.com/terms). We are not responsible for the accuracy or completeness of restaurant information provided by third-party services.
The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We make no warranty regarding the accuracy or reliability of restaurant data sourced from third parties.
To the fullest extent permitted by applicable law, Smak shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, including but not limited to loss of data, loss of profits, or any decisions made based on restaurant recommendations from the App.
You agree to indemnify and hold harmless Smak and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App or your violation of these Terms.
We reserve the right to update these Terms at any time. We will notify you of material changes by updating the "Last Updated" date at the top of this page. Your continued use of the App after any changes constitutes your acceptance of the new Terms.
We reserve the right to suspend or terminate access to the App at any time, without notice, for conduct that we determine violates these Terms or is otherwise harmful to other users, Smak, or third parties.
These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through good-faith negotiation before pursuing any other legal remedy.
